Terms of Service – AbiliMap

1. Acceptance of Terms

By using AbiliMap ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms govern your use of the app on iOS, Android, and web platforms.

2. Eligibility

• Users must be at least 13 years old.
• EU users under 16 require parental consent.
• By using the App, you represent that you meet the age requirements and can enter legally binding agreements.

3. Account Registration

• You must provide accurate information during registration.
• You are responsible for maintaining your account security and password confidentiality.
• You may not share your account credentials with others.
• Boon Ventures LLC reserves the right to suspend or terminate accounts for violations.

4. User Responsibilities

• Submit accurate accessibility reports.
• Respect the privacy and rights of others.
• Do not post offensive, illegal, or misleading content.
• Comply with local laws when taking photos or collecting information.

5. Prohibited Activities

Users may not:

• Harass, bully, or threaten others
• Submit spam, fake, or malicious reports
• Impersonate any person or entity
• Infringe copyright or intellectual property
• Attempt to hack, interfere with, or reverse engineer the App
• Use the App for illegal purposes

6. Content Ownership & License

• Users retain ownership of their submitted reports and photos.
• By submitting content, you grant AbiliMap a worldwide, royalty-free, non-exclusive license to use, display, distribute, and modify reports for app functionality and promotion.
• AbiliMap reserves the right to remove inappropriate content at any time.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which explains data collection, usage, and storage.

8. Disclaimers

• The App is provided "as is" and without warranties.
• Accessibility information is user-generated; accuracy is not guaranteed.
• Users should independently verify critical information.
• AbiliMap is not responsible for injuries, damages, or reliance on app content.

9. Limitation of Liability

• Maximum liability is limited to the amount paid for the App (currently free).
• AbiliMap is not liable for user-generated content, indirect damages, or loss of data.
• Some jurisdictions may not allow certain limitations; if so, liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless Boon Ventures LLC, its affiliates, and employees from claims, damages, or expenses arising from:

• Your use of the App
• Your submitted content
• Your violation of these Terms or applicable laws

11. Third-Party Services

• The App integrates with third-party services (Firebase, Google Maps, Expo, Sentry).
• By using the App, you also agree to the third-party terms and privacy policies.

12. Notifications & Communications

• Push notifications may include report updates, nearby issues, or admin alerts.
• You may opt-in or opt-out via in-app settings.

13. International Users

• Data may be transferred and stored globally.
• Users outside the U.S. consent to international transfers as necessary for app operation.

14. Governing Law & Dispute Resolution

• Governing Law: California, United States
• Dispute Resolution: Binding arbitration under California law.
• Class Action Waiver: You agree to resolve disputes individually; class actions are waived.

15. Modifications to the Terms

• AbiliMap may update these Terms at any time.
• Material changes will be communicated via in-app notification or email.
• Continued use after updates constitutes acceptance.

16. Termination

• We may suspend or terminate accounts for violations of Terms or applicable laws.
• Users may delete their account via in-app settings or by contacting support.
• Termination does not remove obligations accrued prior to termination.

17. Offline Mode & Real-Time Features

• The App supports offline access to reports and cached maps.
• Real-time location updates and report syncing may consume battery and data.

18. Future Features & Monetization

• Currently, the App is free with no in-app purchases.
• Future monetization may include subscriptions, ads, or premium features.
• Users will be notified of any changes to pricing or data usage associated with monetization.

19. Accessibility & User-Generated Content

• AbiliMap promotes accessibility and inclusivity.
• Users are responsible for the accuracy of reports.
• Admin moderation ensures quality and prevents misuse.
